At The Opal Group (throughout this Policy, "us", "we" or "Opal"), your privacy is very important. The purpose of this privacy policy ("Policy") is to provide you (throughout this Policy, "you," "your" or "Authorized User"), as a user of Opal's Services, with a description of the types of Information, including but not limited to first name, maiden name, last name, nicknames, email addresses, business email, business entity filings, corporate affiliations, business associates, business phone number, phone numbers, current and former address, and other similar data, and any and all usage of Services (collectively, the "Information"), we collect about you when you visit any of our Opal sites (collectively, the "Site"), and how we use that Information. By visiting or using the Site, you are accepting the terms and conditions of Opal's Policy. Except as otherwise stated in this Policy, the definitions established in the Agreement (represented by capitalized words in this Policy) have the same meaning in this Policy.
The terms and conditions of the Agreement include, but are not limited to, the provisions of this Policy. If you do not agree to the terms of this Policy, do not use this Site.
Access to the Services is granted only to Authorized Users and such Services may be provided through relationships with a variety of third party Service Providers, Sponsoring Organizations (who may be paying for Authorized Users' access to the Services), or other independent third party service providers or publicly available sources (collectively ("Sources"). This Policy only applies to Information collected while you are on our Site pages. These Site pages may contain links to other websites, software and/or services, including links to websites, software and/or services provided by Sources. Please be aware that when you click on a link that takes you to another website, any Information you provide is subject to the privacy policy of that site, not this Policy. Opal does not control and is not responsible for the practices of other organizations' sites. This Policy does not apply to the practices of organizations that Opal does not own or control, including, but not limited to, the Sources, or to people that we do not employ or manage. Information contained in this Policy may be changed or updated without notice at any time; any such changes will not go into effect until posted here.
1. Information We Collect
We collect and store Information that you voluntarily provide to us, as well as data related to your Site visit and usage. For example, you voluntarily provide Information about yourself when you send us an email, or use certain features of the Site, or register with us. All such Information that you provide is in addition to any Information that may be provided to us pursuant to the process through which your access to our Site was initiated. The Information that Opal collects and stores is kept in accordance with Opal's internal data protection protocols and practices, which include both technical and organizational measures, and which Opal updates and applies as part of the ongoing measures taken to protect such data against unlawful or accidental disclosure.
That said, as a condition of using the Site and the Services discussed in this Policy, you agree that no content or Information submitted in any form to Opal or to any Source shall contain sensitive Information, including but not limited to Personally Identifiable Information (PII), Protected Health Information (PHI), including Information concerning social security numbers, banking numbers, debit card numbers, credit card numbers, driver's license numbers, state-issued identification card numbers, financial account numbers or other financial Information, security codes, access codes, or passwords that would permit access to a financial account.
2. Methods We Use for Gathering Information: Usage Tracking
In addition to the specific uses of your Information required for the performance of Opal's Services to you, Opal analyzes Authorized User traffic patterns throughout its Site. We may also collect generaltypes of data from Authorized Users based on, but not limited to, domain name, web address orbrowser type. This Information is obtained directly from the Authorized User's web address and/orbrowser identification Information.
3. Use of Cookies
A cookie is a short line of text that is created by a website and stored in a file on your computer. Cookies are generally used to store Information about a site user's preferences and activity during and after their visit to a website. Opal's cookies cannot gather any Information from your computer other than that which you provide directly or that is provided routinely by your browser software. Our Site places cookies on your computer, some when you elect the "Remember Me" option on the Site and others regardless of whether or not you choose that option. We use those cookies to enhance Authorized User convenience, track repeat usage and to obtain other Information regarding Site usage by our Authorized Users. Any Authorized User has the right and ability to refuse and/or delete the cookies placed by Opal. However, such refusal or deletion may prevent the Authorized User from properly using the Site's cookie-dependent features, and deletion does not remove Information that you provided or was obtained by us, as described above, prior to such deletion.
4. How We Use Information
Information we collect is generally used for the following purposes:
- To build features that will make the Services available on our Site easier to use. This includes faster search requests and Service responses, better Authorized User support and timely notice of new Services and special offers.
- To improve our marketing and promotional efforts, to analyze Site usage, improve our content and product offerings, and customize our Site's content, layout, and Services. These uses improve our Services and better tailor them to meet your needs.
- To resolve disputes, troubleshoot problems and enforce our Agreement. At times, we may look across multiple Authorized Users to identify problems or resolve disputes.
- To provide general insight to Sources on how their clients are using the Services
5. Disclosure of Information
Opal will not disclose or publish any identifiable confidential Information ("Confidential Information") about an Authorized User or Authorized User's account, other than to any Sources as is necessary to provide Services, without the Authorized User's prior consent unless Opal has a good faith belief that such action is necessary to: (i) comply with legal process or other legal requirements of any governmental authority, (ii) protect and defend the rights or property of Opal; (iii) enforce the Agreement and any and all applicable payment addendums; (iv) protect the interests of other Authorized Users of the Services (as defined in the Agreement); or (v) operate or conduct maintenance and repair of Opal's services or equipment, including the Services as authorized by law.
However, Authorized Users shall have no expectation of confidentiality with respect to the Internet generally. Authorized User's IP address is transmitted and recorded with each message Authorized User sends from the Services. Opal owns all data, communication and Information as a result of Services. Opal may disclose or publish non-confidential Information ("Non-Confidential Information") about an Authorized User or Authorized User's account and usage including, but not limited to, statistical data, trends, traffic, logins, access to Content, general issues supported through Advice Services, actual un-identified questions answered through Advice Services and other Information regarding and resulting from Authorized Users' type of use and frequency of use of the Services. Authorized Users' specific details of the specific communications as part of the Advice Services with Service Providers is strictly confidential and will not be disclosed or published by Opal except on an un-identifiable basis.
6. Vendors
We employ other companies and individuals to perform functions on our behalf; examples include, but are not limited to, providing communications with service providers, analyzing data, sending postal mail and e-mail, removing repetitive Information from Authorized User lists, providing marketing assistance and processing Information ("Vendors"). These Vendors have access to Information in connection with the performance of their functions for Services but are not authorized to use it for other purposes.
7. Children's Privacy
This Site is intended for adult use only by individuals over the age of eighteen (18) years old. We support and comply with all legal and regulatory requirements applicable to the Site including, but not limited to, the Children's Online Privacy Protection Rule ("COPPA"). UNDER NO CIRCUMSTANCES ARE PERSONS WHO ARE NOT AUTHORIZED USERS, OR OTHERWISE AN ADULT USER DULY AUTHORIZED BY OPAL, PERMITTED TO CONNECT TO, ACCESS OR OTHERWISE USE OPAL'S SITE.
8. Effect of Termination of Usage
At the time your use of the Site is terminated, regardless of who terminates said usage, all Information obtained prior to such termination is retained by Opal until it is deleted or destroyed in accordance with our standard Information retention procedures, then in effect. All Information, until such deletion or destruction, is retained in accordance with this Privacy Policy.
9. California Residents
The California Consumer Privacy Act provides California residents with additional rights set forth below which apply to certain businesses. While Opal is not a covered business under the California Consumer Protection Act, Opal is publishing this policy out of an abundance of caution and thus, the following is provided:
Right to Know. You have the right to know and see what data we have collected about you over the past 12 months, including:
- The categories of data we have collected about you;
- The categories of sources from which the data is collected;
- The business or commercial purpose for collecting your data;
- The categories of Sources or Vendors with whom we have shared your data; and
- The specific pieces of data we have collected about you.
Right to Delete. You have the right to request that we delete the data we have collected from you. There are a number of exceptions, however, that include, but are not limited to, when the Information is necessary for Opal or necessary for a Vendor to provide Services.
